Terms in a nutshell (simplified summary for users)
- Free analysis: We review your uploaded documents at our own cost. If we find no error, you pay nothing.
- No risk (No Win, No Fee): Our fee for carrying out the audit and providing the platform — 30% + VAT — is charged only if success is confirmed and a financial benefit is actually achieved (e.g. a refund or an offset against future rent).
- Power of attorney: If the audit reveals an error, you grant a power of attorney to our cooperating lawyer to act with the landlord/property manager on your behalf. You remain the owner of the claim at all times; legal steps are carried out exclusively by the lawyer.
- Fair cooperation: Once we begin recovery steps under the power of attorney, you may not settle directly with the landlord behind our back in order to avoid paying for the work already performed.
This summary is for information purposes only. The provisions below are binding.
Article I. Introductory Provisions and Definitions
1.1 These Terms and Conditions ("Terms") govern the rights and obligations between the Operator and individuals who are tenants ("User") using the rentaudit.cz web platform ("Platform") for the purpose of reviewing utility billing statements related to the use of a rented flat and the potential recovery of overpayments.
1.2 The User is a consumer within the meaning of Section 419 of Act No. 89/2012 Coll., the Civil Code ("Civil Code"), as they do not act within the scope of their business activity or independent profession when concluding and performing the contract.
1.3 "Service" means (i) an online audit and analysis of the correctness of utility billing carried out by the Operator, resulting in the identification of systemic or legal errors by the landlord or property manager (in particular contrary to Decree No. 269/2015 Coll. and Act No. 67/2013 Coll.), and (ii) facilitating legal representation of the User by a cooperating lawyer for the purpose of potential out-of-court or court recovery of unduly charged amounts, based on a power of attorney granted by the User directly to that lawyer. The Operator does not itself provide legal services or recover the User's claims; these acts are carried out exclusively by the Cooperating Lawyer.
Article II. How the Service Works and Conclusion of the Contract
2.1 The contract for provision of the Service is concluded between the Operator and the User at the moment the User completes the form on the Platform, uploads the required documents (in particular the lease agreement and the annual utility billing statement), and submits them together with consent to these Terms.
2.2 Provision of the Service is divided into two phases:
Analysis Phase (Free of charge): The Operator carries out an automated and expert review of the uploaded documents to determine whether the billing contains legal or mathematical errors giving rise to a claim for reimbursement. The result is reviewed by a cooperating lawyer.
Recovery Phase (Conditional): If the analysis reveals an error, the Operator informs the User of the estimated amount of the claim and the proposed course of action. The User decides whether to grant a power of attorney to initiate recovery (Article III).
2.3 Where the analysis identifies indicators of a possible error but lacks the supporting documents necessary to quantify the claim (in particular invoices held by the property manager), the Operator may propose that the User grant a power of attorney to request these documents from the property manager under Section 8 of Act No. 67/2013 Coll.
Article III. Power of Attorney and Legal Representation
3.1 If the User decides to proceed to the Recovery Phase or to request the issuance of documents under Article 2.3, the User shall grant, electronically via the Platform, a power of attorney directly to a cooperating lawyer registered with the Czech Bar Association ("Cooperating Lawyer"). In this relationship, the Operator merely facilitates the introduction between the User and the Cooperating Lawyer and forwards the audit results; the legal representation itself arises directly between the User and the Cooperating Lawyer.
3.2 The claim (the right to reimbursement of an overpayment or other performance) remains the property of the User at all times. Neither the Operator nor the Cooperating Lawyer becomes a creditor of the landlord/property manager. The Cooperating Lawyer always acts in the name and on behalf of the User.
3.3 The costs of legal representation during the Recovery Phase are borne by the Operator, unless otherwise agreed by the parties or unless otherwise required by the circumstances of the case (e.g. an award of costs by the opposing party).
3.4 All amounts recovered from the landlord/property manager shall be paid into a dedicated escrow account of the Cooperating Lawyer. The User undertakes that, when granting the power of attorney, they will also sign a separate payout instruction regarding settlement of funds from the escrow account (a three-party agreement between the User, the Cooperating Lawyer, and the Operator), on the basis of which the Fee will be paid to the Operator under Article IV and the remaining amount to the User. Without this instruction, the Cooperating Lawyer cannot release funds from escrow.
3.5 The User may revoke the granted power of attorney at any time. Revocation during the Recovery Phase is subject to Article V, Section 5.3 of these Terms.
Article IV. Fee for the Audit and Platform Services, and Payment Terms
4.1 The Analysis Phase is provided to the User entirely free of charge, even if the analysis reveals no relevant claim.
4.2 The Operator is entitled to a fee for carrying out the expert audit of the billing, the data analysis, and the provision of the Platform ("Fee") in the amount of 30% + VAT (if the Operator is a VAT payer) of the total financial benefit achieved. The Fee is due exclusively on condition that a financial benefit under Section 4.3 is actually achieved in the matter (a condition precedent) — the Operator therefore does not charge the Fee for the outcome of the legal dispute as such, but for work already performed (the audit and facilitation of the Platform), payment of which is conditional on achieving that benefit. The remaining portion of the benefit achieved belongs to the User.
Form of financial benefit (offset and debt waiver):
4.3 Achieving a financial benefit includes not only the direct crediting of funds to the escrow account, but also situations where the landlord/property manager, following a request from the Cooperating Lawyer, carries out an offset of the claim against the User's future rent, or waives another debt owed by the User in connection with the matter.
4.4 In the case of a benefit under Section 4.3 that was not realized as a payment to the escrow account, the User is obliged to pay the Fee to the Operator based on an issued invoice, within 14 days of receiving the invoice. The User must inform the Operator without undue delay of the realization of such a benefit (offset, debt waiver).
4.5 The Fee is due within 14 days of the recovered amount being credited to the escrow account in accordance with the instruction under Article 3.4, or as set out in Section 4.4.
Article V. Rights and Obligations of the User
5.1 The User must provide the Operator with truthful, complete, and unaltered documents and information. The User is liable for damage caused by submitting false, incomplete, or deliberately altered documents.
5.2 From the moment a power of attorney is granted under Article III (commencement of the Recovery Phase), the User must act in a coordinated manner with the Operator and the Cooperating Lawyer. In particular, the User may not, without first informing the Operator, enter into a settlement with the landlord/property manager regarding the claim, accept payment from them relating to the claim, or hand the matter to a third party, unless the User has first revoked the power of attorney under Section 5.3.
5.3 The User is entitled to revoke the power of attorney at any time. However, if the User breaches the obligation under Section 5.2 (i.e. accepts payment directly from the landlord/property manager or enters into a settlement regarding the claim without revoking the power of attorney and informing the Operator beforehand) in a situation where the Operator or the Cooperating Lawyer has already actively acted in the matter (in particular by sending a demand letter, filing a request for documents, or initiating negotiations with the landlord/property manager), the Operator is entitled to charge for the audit, data analysis, and facilitation of legal representation already performed, in an amount equal to the costs and time actually incurred (in particular the cost of filing a request under Section 8 of Act No. 67/2013 Coll., and the lawyer's and the Operator's time spent on the matter), but no less than CZK 1,000. This does not affect the User's right to revoke the power of attorney at any time under Section 33b of the Civil Code.
5.4 Section 5.3 does not apply if the User revoked the power of attorney before the Operator or the Cooperating Lawyer took any action whatsoever toward the landlord/property manager in the matter.
Article VI. Obligations of the Operator
6.1 The Operator undertakes to carry out the Analysis Phase with due professional care and within a reasonable timeframe (typically within 2 business days of receiving complete documents).
6.2 The Operator shall ensure that all legal steps during the Recovery Phase are carried out exclusively by the Cooperating Lawyer under a power of attorney granted by the User.
6.3 The Operator processes the User's documents and personal data in accordance with the GDPR and the Privacy Policy available on the Platform.
6.4 The Operator is not liable for the outcome of the Analysis Phase or the Recovery Phase, nor for the outcome of any subsequent court or out-of-court proceedings. The Operator is not liable for damage caused by incomplete or untruthful documents submitted by the User.
Article VII. Consumer Protection and Withdrawal from the Contract
7.1 As the contract is concluded by distance means (online), the User, as a consumer, has the right to withdraw from the contract without giving any reason within 14 days of its conclusion, pursuant to Section 1829 et seq. of the Civil Code.
7.2 By submitting the form and documents on the Platform, the User expressly consents and requests that the Operator begin providing the Service (the Analysis Phase) before the expiry of the 14-day withdrawal period referred to in Section 7.1.
7.3 The User acknowledges that, pursuant to Section 1837(a) of the Civil Code, the right to withdraw from the contract in respect of the Analysis Phase ceases once the Analysis Phase has been fully performed (i.e. once its result has been communicated). This does not affect the User's right to revoke, at any time, a power of attorney granted during the Recovery Phase in accordance with Article V.
7.4 In the event of a consumer dispute that cannot be resolved amicably between the parties directly, the User has the right to submit a proposal for out-of-court dispute resolution to the Czech Trade Inspection Authority (ČOI), Central Inspectorate – ADR Department, Štěpánská 44, 110 00 Prague 1 (www.coi.cz, adr.coi.cz).
Article VIII. Confidentiality and Data Protection
8.1 The Operator processes the User's personal data in accordance with the GDPR and Act No. 110/2019 Coll. Details are set out in the Privacy Policy, which forms an integral part of the contractual relationship.
8.2 Both parties shall maintain confidentiality regarding information obtained in connection with the performance of the contract, even after its termination, except for information whose disclosure is required by law or a court decision.
Article IX. Final Provisions
9.1 Legal relationships established by these Terms are governed by the law of the Czech Republic, in particular the Civil Code and Act No. 634/1992 Coll., on Consumer Protection.
9.2 If any provision of these Terms is or becomes invalid or ineffective, this shall not affect the validity of the remaining provisions.
9.3 The Operator may amend these Terms to a reasonable extent. The new version will be published on the Platform and the User will be notified by email at least 14 days before it takes effect. If the User does not agree with the amended Terms, the User has the right to terminate the contract as of the effective date of the amendment, by notice sent to info@rentaudit.cz. If the User does not terminate the contract and continues to use or receive the Service after the amendment takes effect, the new version of the Terms is deemed accepted. For cases already concluded and in progress, the version of the Terms effective at the time the contract was concluded shall apply, unless the parties agree otherwise.
9.4 These Terms take effect on 16 June 2026.
